In exercise of the power confirmed by subsection (2) of the section 29 read with section 14 of the Protection of Plant Varieties and Farmers Rights Act, 2001 (53 of 2001), the Central Government notified crops with their genera and species eligible for registration of varieties under the said Act in various phases:
First Phase: Gazette Notification No. 1316 dated Nov. 01, 2006 (here) specified 12 crops (1) Rice (2) Wheat (3) Maize (4) Sorghum (5) Pearl Millet (6) Pigeon pea (7) Green bean (8) Black bean (9) French bean (10) Peas (11) Lentil and (12) Chick pea with their genera and species eligible for registration of varieties.
Second Phase: Gazette Notification No. 1619 dated Dec. 31, 2007 (here) specified 2 crops (1) Cotton and (2) Jute are eligible with their genera and species eligible for registration of varieties.
Third Phase: Gazette Notification No. 1200 dated Aug. 03, 2009 (here) specified 3 crops (1) Sugarcane (2) Ginger and (3) Turmeric with their genera and species eligible for registration of varieties.
Fourth Phase: Gazette Notification No. 828 dated 30th April 2010 (here) specified 11 crops (1) Black pepper (2)Small cardamom (3)Indian mustard (4) Rape seed (5)Sunflower (6) Safflower (7) Castor (8) Sesame (9) Linseed (10) Groundnut (11)Soybean with their genera and species eligible for registration of varieties.
Fifth Phase: Gazette Notification No. 2883 dated Dec. 02, 2010 (here)specified 11 crops as Potato (2) Garlic (3) Onion (4) Tomato (5)Brinjal (6) Cauliflower (7) Cabbage (8) Lady's finger (9) Rose (10) Mango (11) Chrysanthemum with their genera and species eligible for registration of varieties.
Till dated 18.07.2011, Central Government has notified 39 Crops with their genera & species and we are expecting some more notifications in coming days. An application for registration can be file under any category as New, Extant, Farmer’s and EDVs for all the crop genera and species notified.
